BOOKING TERMS, SAFETY & EVENT POLICIES

INTRODUCTION

Thank you for choosing On Par Co.

These Event Booking Terms & Conditions outline the policies, responsibilities, and expectations that apply to all bookings with On Par Co. They are designed to ensure a safe, professional, and enjoyable experience for our clients and their guests while protecting the safety of participants, our team members, and our equipment.

By requesting a quote, confirming a booking, paying a deposit, or participating in an event operated by On Par Co., the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.

BOOKING CONFIRMATION

A booking is considered confirmed once:

  • On Par Co. has accepted the booking request;

  • any required deposit has been received; and

  • the event details have been confirmed by both parties.

Until a booking has been confirmed, On Par Co. reserves the right to accept other bookings for the requested date and time.

PRICING, DEPOSITS & PAYMENT

Unless otherwise stated in writing, a 25% non-refundable deposit is required to secure all bookings.

The remaining balance is due before or on the day of the event as outlined in the booking confirmation or invoice.

Additional charges may apply if the event duration, location, staffing requirements, or requested services change after booking confirmation.

Late payments may be subject to interest charges and collection costs where permitted by applicable law.

EVENT CHANGES

The Client may request changes to the event date, time, duration, location, or services.

While On Par Co. will make every reasonable effort to accommodate requested changes, modifications cannot be guaranteed and may be subject to:

  • availability;

  • updated pricing;

  • additional staffing charges;

  • additional travel costs; or

  • revised setup requirements.

CANCELLATION & RESCHEDULING POLICY

At On Par Co., we understand that plans can change. We will make every reasonable effort to accommodate changes whenever possible while recognizing that event bookings require advance scheduling, staffing, equipment preparation, and often prevent us from accepting other bookings.

CLIENT CANCELLATIONS

All deposits are non-refundable and secure the exclusive reservation of your event date and time.

If the Client cancels an event, the following fees may apply:

  • More than 30 days before the event: Deposit retained. Any additional payments made beyond the deposit will be refunded.

  • 15–30 days before the event: Deposit retained plus up to 25% of the remaining booking balance may be charged.

  • 7–14 days before the event: Up to 50% of the total booking fee may be charged.

  • Less than 7 days before the event: Up to 100% of the total booking fee may be charged.

Cancellation fees reflect staffing commitments, equipment preparation, travel planning, administrative work, and the potential loss of other booking opportunities.

CLIENT RESCHEDULING

Requests to reschedule an event will be accommodated whenever reasonably possible and are subject to availability.

Where sufficient notice is provided and the requested date is available, On Par Co. may, at its sole discretion, transfer the Client's deposit to one future event date within twelve (12) months of the original booking.

Only one complimentary reschedule is permitted. Additional date changes may be subject to administrative fees or updated pricing.

EARLY EVENT COMPLETION

If an event concludes earlier than the contracted booking time due to Client request, venue restrictions, guest attendance, or any circumstance outside of On Par Co.'s control, the full contracted booking fee remains payable.

CANCELLATIONS BY ON PAR CO.

If On Par Co. must cancel an event for reasons other than weather, force majeure, or circumstances beyond our reasonable control, the Client will be offered either:

  • a full refund of all amounts paid; or

  • the opportunity to reschedule the event to a mutually agreeable date.

WEATHER-RELATED CANCELLATIONS

Weather-related delays, modifications, suspensions, or cancellations are governed by the Weather Policy outlined below and do not constitute a cancellation by On Par Co.

WEATHER POLICY

Many On Par Co. experiences operate outdoors where weather conditions can affect both participant safety and the operation of specialized equipment.

The safety of our guests, team members, and equipment will always take priority.

On Par Co. reserves the sole right to delay, modify, suspend, relocate, or cancel setup or event operations whenever weather or environmental conditions are determined to be unsafe.

Unsafe conditions may include, but are not limited to:

  • lightning;

  • heavy rain;

  • hail;

  • snow or freezing precipitation;

  • high winds;

  • wildfire smoke or poor air quality;

  • flooding;

  • excessive heat;

  • severe weather warnings; or

  • any other condition that could reasonably create a safety risk or damage equipment.

Whenever practical, On Par Co. will work with the Client to:

  • delay the event;

  • relocate the experience indoors (where feasible);

  • modify the event format; or

  • reschedule the booking to another mutually agreeable date within twelve (12) months, subject to availability.

Weather-related interruptions or cancellations do not automatically entitle the Client to a refund. Any credits, partial refunds, or rescheduling arrangements remain at the sole discretion of On Par Co., taking into consideration staffing, travel, setup completed, equipment transportation, and other operating costs.

OUTDOOR OPERATING CONDITIONS

Outdoor operation of our mobile golf simulator requires safe environmental conditions.

Even when weather forecasts appear favourable, actual onsite conditions may differ.

On Par Co. reserves the sole discretion to determine whether conditions allow for safe setup and operation.

Operation may be delayed, suspended, modified, or cancelled due to:

  • unsafe wind conditions;

  • lightning;

  • excessive heat;

  • poor air quality;

  • unstable ground conditions; or

  • any other environmental factor that may compromise safety or equipment.

Safety decisions made by On Par Co. team members onsite are final.

SITE REQUIREMENTS

The Client is responsible for ensuring the venue is suitable for setup and operation.

Unless otherwise approved by On Par Co., the site must provide:

  • sufficient space for the selected setup;

  • appropriate ceiling height where applicable (11.5 feet high);

  • level and stable ground;

  • safe loading and unloading access;

  • adequate electrical power when required;

  • clearance from overhead hazards including trees, wires, lights, or structures;

  • all necessary venue permissions.

If the site is deemed unsafe or unsuitable upon arrival, On Par Co. reserves the right to modify or cancel services without liability.

TRAVEL, ACCESS & VENUE CONDITIONS

The Client is responsible for ensuring reasonable access to the event location.

Additional charges may apply where setup requires:

  • excessive walking distances;

  • multiple trips to transport equipment;

  • stairs or elevators not previously disclosed;

  • difficult terrain;

  • paid parking;

  • ferry transportation;

  • extended wait times;

  • restricted loading access; or

  • any additional labour beyond what was reasonably anticipated during booking.

Any known access restrictions should be communicated before the event date.

CLIENT RESPONSIBILITIES

The Client agrees to:

  • provide accurate event information;

  • obtain all required venue approvals and permissions;

  • ensure safe access to the event location;

  • advise On Par Co. of any known hazards before arrival;

  • designate an onsite event contact;

  • maintain a safe environment for guests and staff throughout the event.

PARTICIPANT SAFETY

Golf simulator activities involve inherent risks.

Participants are expected to:

  • follow all instructions provided by On Par Co. staff;

  • remain behind the designated hitting area until instructed;

  • use equipment only as intended;

  • avoid reckless behaviour;

  • respect safety barriers and designated spectator areas.

Children under the age of sixteen (16) must remain under adult supervision at all times.

On Par Co. reserves the right to temporarily suspend play whenever safety concerns arise.

RIGHT TO REFUSE PARTICIPATION

On Par Co. reserves the right to refuse or discontinue participation for any individual who:

  • appears impaired by alcohol or drugs;

  • behaves aggressively, abusively, or inappropriately;

  • refuses to follow staff instructions;

  • intentionally misuses equipment;

  • creates an unsafe environment; or

  • may reasonably endanger themselves or others.

Safety decisions made by On Par Co. staff are final.

No refunds will be provided where participation is refused for safety-related reasons.

EQUIPMENT USE & PROTECTION

All equipment supplied by On Par Co. remains the exclusive property of On Par Co.

Equipment may only be operated under the supervision of authorized On Par Co. personnel unless otherwise approved.

The Client may be responsible for repair or replacement costs resulting from:

  • intentional misuse;

  • negligence;

  • vandalism;

  • theft;

  • unauthorized operation; or

  • failure to take reasonable care of equipment.

ALCOHOL & IMPAIRMENT

Alcohol may be present at many private and corporate events.

On Par Co. reserves the right to refuse participation or suspend play for any participant whose level of impairment or behaviour presents a safety concern.

EMERGENCY SUSPENSION OF SERVICES

On Par Co. may immediately suspend or terminate event operations where necessary to protect participants, staff, equipment, or property.

This includes, but is not limited to:

  • severe weather;

  • lightning;

  • equipment malfunction;

  • power failure;

  • unsafe venue conditions;

  • medical emergencies;

  • aggressive participant behaviour; or

  • any unforeseen circumstance creating an unreasonable safety risk.

ASSUMPTION OF RISK

Participation in golf simulator activities involves inherent risks including, but not limited to:

  • swinging golf clubs;

  • struck golf balls;

  • slips, trips, and falls;

  • equipment malfunction;

  • accidental contact with equipment or other participants.

By participating, individuals voluntarily accept these inherent risks.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, On Par Co. shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of its services.

The total liability of On Par Co. arising from any claim related to an event shall not exceed the total amount paid by the Client for the applicable booking.

FORCE MAJEURE

On Par Co. shall not be liable for delays, interruptions, cancellations, or failure to perform resulting from circumstances beyond its reasonable control.

Such circumstances include, but are not limited to:

  • severe weather;

  • wildfire smoke;

  • natural disasters;

  • government restrictions;

  • labour disputes;

  • transportation disruptions;

  • public health emergencies;

  • utility failures;

  • civil unrest; or

  • any other event beyond the reasonable control of On Par Co.

PHOTOGRAPHY & MARKETING

Unless the Client requests otherwise in writing before the event, On Par Co. may photograph or record portions of the event for promotional, marketing, or social media purposes.

Reasonable efforts will be made to respect privacy requests.

PRIVACY

Personal information collected through bookings or inquiries will only be used to provide requested services, communicate regarding bookings, process payments, improve customer service, and meet legal obligations.

On Par Co. does not sell personal information to third parties.

GOVERNING LAW

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of Manitoba and the applicable laws of Canada.

SEVERABILITY

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

ENTIRE AGREEMENT

These Terms & Conditions, together with any quotation, booking confirmation, invoice, waiver, or written agreement issued by On Par Co., constitute the entire agreement between the Client and On Par Co. relating to the event.

Any amendments must be agreed to in writing by both parties.
