Privacy Policy for On Par Mobile Golf Events

1. Introduction

XR On Par Co. | Mobile Golf Simulator Events (“we”, “us”, “our”) is committed to protecting the privacy and security of personal information in compliance with applicable Canadian privacy laws. This Privacy Policy describes how we collect, use, disclose, retain, and protect personal information in connection with our golf events and related services, particularly in Manitoba.

By registering for or participating in our events, using our website, or otherwise providing us with your personal information, you consent to the practices described in this policy (subject to applicable legal rights).

2. Scope & Legal Framework

  • We are a private-sector organization operating in Canada. The Personal Information Protection and Electronic Documents Act (PIPEDA) applies to our collection, use, and disclosure of personal information in the course of our commercial activities.

  • In Manitoba, there is currently no comprehensive provincial private-sector privacy statute that parallels PIPEDA, so PIPEDA generally governs our private-sector operations.

  • To the extent we deal with public bodies or protected sectors (e.g. health information or other regulated data), we will also comport with applicable statutes (like Manitoba’s FIPPA, PHIA) as needed.

If any provincial law comes into force in Manitoba in the future that governs private-sector privacy, this policy will be updated accordingly.

3. Definitions

  • Personal Information means any information about an identifiable individual (e.g. name, contact details, date of birth, payment information, photographs).

  • Sensitive Personal Information includes information such as health information, biometric data, or other information that could cause significant harm if disclosed.

  • Event Participants means participants, players, attendees, sponsors, volunteers, staff, vendors, or other persons involved in our golf events.

  • Service Providers means third parties engaged to support our operations (e.g. payment processors, registration platforms, IT providers).

4. What Personal Information We Collect

We collect personal information that is reasonably necessary for one or more legitimate business purposes in organizing and running golf events, which may include:

  • Identity & contact: Name, postal address, email address, phone number

  • Registration & event details: Handicap, golf club affiliation, registration history, event preferences

  • Payment & billing: Credit card number or payment account, billing address

  • Photographs & media: Photos or video recordings of participants during events

  • Communications & marketing: Preferences for receiving communications, opt-in status

  • Health & safety: (if applicable)Emergency contact, relevant medical conditions (if voluntarily disclosed, e.g. for event safety)

  • Technical & usage: IP address, device identifiers, cookies, website usage data

We will only collect personal information by fair and lawful means and as necessary for the identified purposes.

5. How We Use Personal Information

We use personal information for purposes which may include, but are not limited to:

  1. Event administration (registration, scheduling, scoring, tee times, results).

  2. Payment processing (billing, refunds).

  3. Communications (sending confirmations, event updates, newsletters, promotional offers) — only if you have consented.

  4. Marketing & promotions (with your consent).

  5. Photography & media use (e.g. publishing photos, event coverage) — subject to consent or notice.

  6. Health & safety (supporting emergency response or medical considerations during events).

  7. Analysis, improvement, and security (fraud prevention, internal reviews, improving services).

  8. Legal compliance & protection (comply with laws, respond to legal requests, protect our rights).

We will not use or disclose your personal information for a purpose other than those for which it was collected, except with your consent or as otherwise permitted or required by law.

6. Consent

  • Where required, we will seek your informed consent (express or implied) before collecting, using, or disclosing your personal information.

  • Consent may be obtained electronically (e.g. checkbox at registration), verbally, or in writing.

  • You may withdraw or modify your consent at any time, subject to legal or contractual restrictions, by contacting us (see Section 11).

  • If you withdraw consent, we may not be able to provide you with certain services (e.g. participation in events). We will inform you of the consequences of withdrawal.

7. Disclosure & Third Parties

We may disclose personal information to the following categories of third parties:

  • Service providers (e.g. payment processors, registration systems, IT hosting, photographers, scoring services) under contractual obligations of confidentiality.

  • Event partners, sponsors, or affiliated organizations, where relevant and with your consent.

  • Legal authorities or regulators, as required by law or court order.

  • Successors or assignees, in case of a merger or sale of assets (with notice or as permitted by law).

We require those third parties to protect personal information in a manner consistent with this policy.

8. Photographs and Event Media

During our events, we may take photographs or video footage of participants, spectators, and volunteers. These media may be used for promotional, marketing, or archival purposes (e.g. on our website, social media, printed materials). By participating in our events, you may be captured in these images unless you explicitly opt out in advance.

If you prefer not to be photographed or have your image used, you may notify us ahead of the event, and we will make reasonable efforts to avoid including you in future media.

9. Retention and Disposal

We retain personal information only as long as necessary for the purposes for which it was collected or for legal or business requirements. When personal information is no longer required, we will securely delete, anonymize, or destroy it.

We maintain records of privacy breaches (whether or not a breach poses a real risk of significant harm) for at least two years, as required by PIPEDA.

10. Security Safeguards

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, copying, use or modification. Examples include:

  • Encryption (in transit and at rest)

  • Access controls and authentication

  • Employee training and confidentiality obligations

  • Regular review of security practices

  • Secure disposal of information

If a breach of security safeguards occurs and it is reasonable to believe there is a real risk of significant harm to an individual, we will notify affected individuals and report the breach to the Office of the Privacy Commissioner of Canada, as required by law.  Canada

11. Access, Correction, and Complaints

  • Access & correction: You have the right to access personal information we hold about you and request corrections if inaccuracies exist. We will respond to such requests in a timely manner, subject to any legal exemptions.

  • Complaints: If you believe we have breached this Privacy Policy or applicable law, you may contact us (see below). We will investigate and respond.

  • If you are dissatisfied with our response, you may contact the Office of the Privacy Commissioner of Canada (for PIPEDA matters).

12. Children and Minors

We do not knowingly collect personal information from minors (under age 13) without parental consent. If you believe that we have collected personal information from a minor without appropriate consent, please contact us and we will take steps to delete that information.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time (for example, to reflect changes in law or our practices). We will post the revised policy on our website with the “Last updated” date. Significant changes may be communicated to you (e.g. via email) where appropriate.
